This image is in the public domain according to Article 4, case 2 of the Polish Copyright Law Act of February 4, 1994 (Dz. U. z 2022 r. poz. 2509 with later changes) "normative acts and drafts thereof as well as official documents, materials, signs and symbols are not subject to copyrights". Hence it is assumed that this image has been released into public domain. However in some instances the use of this image in Poland might be regulated by other laws.
An official pre-war portrait done in order to fulfil his duty as an officer. As such it's PD, but this picture was also published in pre-1994 Poland so PD-PRL is also applicable.
This work is in the public domain in the United States because it meets three requirements:
it was first published outside the United States (and not published in the U.S. within 30 days),
it was first published before 1 March 1989 without copyright notice or before 1964 without copyright renewal or before the source country established copyright relations with the United States,
it was in the public domain in its home country (Poland) on the URAA date (1 January 1996).

Note, Nazi Germany did not invade Poland until September 1939. The soldiers are not marching past a Nazi swastika as the file name might imply, rather more specifically it is the regiment's signature Highlander's Cross of similar appearance.
